Terms of Service

Please read these terms carefully before using our services.

Definitions

If you see the words "ServerManagementPlus", "us", "our" or "we" mentioned below, it refers to the ServerManagementPlus.com owners, management, and all employees.

If you see the words "you", "your", "client" or "customer" mentioned below, it refers to you—the person, company, organization, or group who signed up for our service.

Disclaimer

You must agree that ServerManagementPlus under any circumstances will not be responsible for any damages your business may suffer.

ServerManagementPlus makes no warranties of any kind, expressed or implied for services we provide. ServerManagementPlus disclaims all implied warranties of merchantability or fitness for a particular purpose. This includes but is not limited to loss of data resulting from delays, hacking from insecurities, prolonged downtime from lack of action to monitoring, non-deliveries, wrong delivery, and any and all service interruptions caused by ServerManagementPlus staff.

ServerManagementPlus reserves the right to amend or update these policies without notice. Failure to follow any terms and conditions may result in account deactivation.

Although we do our best to maintain a very high quality service and availability, services provided by ServerManagementPlus are not designed for mission critical use, and should not be used for such purposes. Our services should only be used for fault-tolerant purposes which allow for failure.

Single Account

You must only have one account with us. If your email address is changed then you can update it from your client area or contact our billing department to update it. Signing up for 2 or more accounts is not allowed. If we find you having multiple accounts with us then we reserve the right to terminate your account and services without refund.

Money Back Guarantee & Refunds

ServerManagementPlus offers a money back guarantee on our server management services. If you are not completely satisfied with our services within the first 3 technical support requests/issues or first 7 days of using our service (whichever comes first) from the date of your signup, you will be given a full refund of the amount paid EXCLUDING SETUP FEES.

  • Applies to first time customers for single (one) service only.
  • If you use our service and cancel, then signup again at a later date, the refund policy is no longer applicable.
  • If you signup for two or more servers and cancel then refund of only one (1) server will be provided.

In certain instances at our sole discretion, we reserve the right to delete, remove and/or undo any work that was performed on your server(s) during the period in which a refund is or was requested and/or given.

Disputes & Chargebacks

All payments after the first 7 days of service are non-refundable. Any incorrect, overcharges or billing disputes must be reported to us within 60 days.

If you dispute a charge to your credit card issuer or PayPal, you agree to pay us an "Administrative Fee" of $50 per dispute.

Cancellation & Non-Payment

There are no long term contracts. You can cancel the service anytime. If you are paying by PayPal, it is your responsibility to cancel the automatic subscription to avoid renewal.

If payment is not received by due date then your service will be suspended. You have 3 days to reactivate it. If not renewed within 3 days of suspension, services will be terminated.

Prices

Prices are subject to change without notice. However, your price will remain the same as when you signed up during your contract period.

Response Time and Resolution Time

"Response" The tech on duty has read the ticket, assigned it, and replied stating work has started.
"Resolution" A technician has resolved the problem in the ticket.

For support tickets, we offer and guarantee an initial response within 12 hours, and subsequent responses and resolutions within 16 hours per ticket.

Our Response and Resolution time guarantees apply to the first 1 ticket per 24 hours, or the first 10 tickets per 30 days, or the first 2 hours of work per 30 days, whichever comes first. Additional tickets are not covered under our guarantees.

Note: Sales, billing, or any other non-support related issue is not covered under our Response and Resolution time guarantee. Bumping tickets pushes them to the bottom of the list, causing delays.

Access to Servers & IP Changes

ServerManagementPlus requires administrative access to your server(s) to provide services. If proper information is not provided, we cannot be responsible for any issues.

Our services are locked to the server IP you signed up for. It cannot be changed in the middle of service. If you have a new server, you must order a new service.

Backups

We do not make any backups of your data. Backup software is enabled upon your request only. We do not store or save any of the data that is backed up. It is absolutely necessary that you check the backup files on a frequent and regular basis.

Scheduled Tasks

To schedule tickets, time must be specified in our Indian Standard Time zone. We must be given 24 hours advance notice and at least an 8 hour window. If we are unable to complete it within the requested time window, it will be automatically rescheduled for the same time window the following day.

Non-Covered Issues & 3rd Party Software

We do not support 3rd party software. We only install it as per official documentation and cannot guarantee it will work.

We do not provide technical support for custom software applications. If you have custom-coded software, it is your responsibility to maintain it. We will not be responsible for any changes you or someone else makes in your server.

Exceptions & Service Interruptions

It is your responsibility to make every attempt to resolve basic issues (adding websites, rebooting, etc.). We retain the right to determine how much support we will provide.

We shall not be responsible for any delay or failure in performance resulting from reasons beyond our control (acts of God, power failure, etc.).

Abuse & Customer Conduct

Abuse or disrespect directed towards any of our staff will never be tolerated. If you are disrespectful, use foul language, threaten us, or post invalid negative information publicly, you will be considered in severe breach of this agreement.

Violations carry penalties including warning, suspension, or cancellation without refund. Re-activation may be subject to a $75.00 Administrative Charge.

Fair Use

We provide unlimited support tickets at a very low price, but this is a shared service. If we find that your support requests are resulting in degraded support for our other clients, we reserve the right to suspend or cancel your service. This is a server management service, NOT a website or account management service.

Modifications & Agreement

We reserve the right to change the Agreement at any time. You can check this page regularly for changes. You acknowledge that any changes or modifications shall not constitute grounds for non-payment. We reserve the right to refuse service to anyone.
